Revised general transport conditions

Applicability of Conditions

 

1. Passengers are required to adhere to these General Transport Conditions, as well as the relevant laws of Romania and the countries through which they travel.

 

2. It is the passengers' responsibility to comply with the entry/exit regulations and the customs, financial, and administrative provisions of the transited countries. The carrier will not bear additional costs caused by the lack of necessary documents.

 

3. The carrier and its agents are not responsible for passengers' non-compliance with applicable legislation.

 

4. In the event passengers are detained at the border for failing to comply with the necessary formalities, and if resolving the situation exceeds one hour, the coach will continue its journey.

 

Definitions

 

1. Legal provisions regarding transport contracts exempt the carrier from liability in certain cases.

 

2. Returned tickets are those for which the value is reimbursed, according to the specified conditions (Appendix 1), if the passenger cancels their trip.

 

3. The departure date is the date specified on the ticket as the start of the journey.

 

Tickets, Validity, Reservations

 

1. The ticket is nominative (cannot be transferred to another person) and must be presented upon request by the company staff or authorized control authorities. The ticket serves as proof of the transport contract between the passenger and the carrier.

 

2. Tickets without the issuer's stamp or date of issue are not valid.

 

3. The ticket's validity starts from the departure date noted on it.

 

4. Cancellation and ticket return are only done at the issuing agency, adhering to applicable regulations.

 

5. Any change of travel date must be announced at the agency where the ticket was purchased or at the COMATI-PSG agency, with fees applied according to the regulation if applicable, as per Appendix 1.

 

6. Round-trip tickets are valid for six months from the departure date.

 

7. Comati-PSG does not guarantee the availability of seats on the desired date by the traveler and will not be liable for damages suffered by the traveler due to the impossibility of traveling on the desired date.

 

8. For round-trip tickets purchased, scheduling for the return must be made at least 7 days before departure at the SC COMATI PSG SRL office or on the website www.comati-psg.ro

 

9. Tickets with promotional prices or fixed periods cannot be modified or refunded if not used within the validity period.

 

10. The carrier may sell unconfirmed (reserved) seats.

 

11. In the case of rescheduling the travel date in other countries, local regulations and administration fees will apply.

 

12. Returning tickets issued by partner agencies is only done at the issuing agency, according to Appendix 1.

 

13. Tickets purchased online are available on board the coaches.

 

Lost Ticket, Cancellation, Rescheduling, Compensation

 

1. Lost, destroyed, or stolen tickets can be reissued for a fee of 10 euros.

 

2. Insurance for such situations is recommended.

 

3. The value of penalties for cancellation, rescheduling, or return is specified in the regulation (Appendix 1).

 

4. The passenger cannot receive back more than 100% of the ticket value.

 

5. The ticket price corresponds to the rates on the day of issuance.

 

6. The passenger must check if the ticket has the corresponding number of pages at the time of purchase or when returned by the coach crew after the control.

 

7. Promotional tickets and special offers are not subject to cancellation or refund.

 

8. Requests for return, compensation claims, and/or complaints regarding the travel execution must be submitted in writing to the COMATI PSG headquarters in Romania or the agency where the ticket was purchased within a maximum of one month from the departure date noted on the travel ticket in the case of one-way tickets and tickets with a fixed return date, and a maximum of 6 months in the case of OPEN round-trip tickets (medical emergencies, death, and others included in the force majeure definition).

 

9. A return ticket where the passenger did not show up for boarding and did not previously announce the change or cancellation of the trip according to Appendix 1, will result in the cancellation of the return ticket, without the right to reschedule or compensate the passenger.

 

Luggage

 

1. The document bag and food bag may be taken on the coach as hand luggage. Hand luggage (maximum 5 kg) must be stored in the special spaces on the coach, not under the seats or in the aisle.

 

2. SC Comati-PSG is not responsible for the loss or damage of hand luggage, except in cases where the carrier's fault can be proven.

 

3. SC COMATI PSG SRL is not responsible for the loss or damage of goods such as money, gold, silver, jewelry, artworks, or other valuables such as cameras, video cameras, computers, etc., located in the passengers' hand luggage.

 

4. The responsibility for the theft, loss, or damage of luggage stored in the luggage compartment, other than hand luggage, falls on SC COMATI PSG SRL or the company authorized by it to perform the transport, only if these occur due to the intentional negligence of the coach crew, which must be proven by the claimant, and only up to 200 Euros, except for the goods mentioned in point 3.

 

5. Complaints regarding luggage must be made immediately upon arrival. Complaints should be sent to info@comati-psg.ro.

 

6. Luggage insurance for amounts over 200 euros is recommended.

 

7. The adult ticket price includes 50 kg of luggage and 30 kg for a child (1 or 2 bags with dimensions 70/40/20 cm), which will be stored in the coach's luggage compartment, as well as a hand luggage of maximum 5 kg (purse, backpack), which can be taken inside the coach. Electronic equipment, household appliances, bicycles, tires, and bulky items are not considered checked luggage (the 50 kg) but as parcels and will be calculated according to the company's rates, requiring prior notification to check the availability of storage space on the coach. COMATI PSG reserves the right to refuse the transport of these parcels if they are not properly packaged.

5.8 The transport of animals is not allowed.

 

8. It is strictly prohibited in luggage to transport drugs, explosive or toxic substances, weapons, ammunition, oxygen or gas cylinders, bottles, or any other caustic dangerous substances, heritage artworks without the necessary permits, as well as other objects and substances that violate the laws in force in Romania or other countries. All luggage must be labeled so that the owner of the luggage is clearly visible.

 

Delays, Cancellations, Modifications

 

1. SC COMATI PSG SRL assumes no responsibility for delays in services and/or for losses suffered by the traveler as a result of these delays. Arrival times depend on waiting times at borders and on the roads.

 

2. SC COMATI PSG SRL reserves the right, at any time, to cancel a trip in case of the threat or existence of a war, armed conflict, terrorist attack, blockade, strike, unfavorable weather conditions, social movements, technical problems of the coach, or other circumstances that could be an impediment to the execution of the trip.

 

3. Any changes to rates or schedules will be communicated to passengers in advance.

 

 

Transporter

 

1. Persons with disabilities or reduced mobility notify the transporter at the time of booking the ticket of their specific needs regarding the seat, provided that this need is known at that time. They can only travel accompanied by a person who can provide assistance during transport.

 

2. In accordance with the provisions of European Regulation 181/2011, the transporter declares that the coaches/means of transport used in its activity are not designed accordingly to ensure the safe transportation of persons with disabilities and persons with reduced mobility.

 

Passenger Responsibilities

 

1. Children under 18 years require a notarized agreement document for travel.

 

2. Medical insurance is recommended but is not included in the ticket price.

 

Passenger Obligations

 

1. The use of audio devices without headphones and inappropriate behavior is prohibited.

 

2. The transporter has the right to refuse transport or to interrupt it without the right to compensation or refund of the ticket price if the passenger does not respect the transport contract conditions, violates the laws on the territory of Romania or other countries through which they travel, in case they are in a state that indicates a contagious disease, have uncivilized behavior in the coach or towards other passengers and endanger the safety of other passengers by disturbing the trip (including passengers intoxicated, under the influence of narcotics with violent, immoral, and indecent behavior).

 

3. Smoking in coaches is strictly forbidden. Passengers who smoke in the coach will be removed from the coach without the right to compensation or refund of the ticket price.

 

4. Access to the coach during ferry-boat crossings is prohibited. It is the traveler's responsibility to take their hand luggage with them when disembarking from the coach.

 

5. It is the traveler's responsibility to ensure that they have all the necessary travel documents for entering, transiting, or staying in a foreign country such as a passport, visas, medical certificate. If during the trip, the traveler is denied the right to enter or transit a country due to not having the correct travel documents, all consequences, including all damages suffered by SC COMATI PSG SRL, fall under the responsibility and will be borne by the traveler, without being able to benefit from any total or partial refund of the travel fare.

 

6. Travelers must present themselves at the boarding point at least 30 min. before the departure time, except in cases where otherwise stated in the line's brochure. Any delay entails the unilateral responsibility of the delayed passenger.

 

7. In the case of regular stops along the route, travelers must return to the coach within the announced time before the stop, otherwise, the coach will leave the station without the unattended travelers, SC COMATI PSG SRL assuming no responsibility for the consequences of this fact.

 

8. Throughout the trip, the traveler must respect the safety conditions and rules on board the coach, rules that are displayed or will be handed to the traveler by the crew of SC COMATI PSG SRL

 

9. Complaints and grievances regarding the fulfillment of the transport contract by SC COMATI PSG SRL observed by the traveler must be reported in writing in the shortest time, but in no more than one month from the date of the trip, except in cases where another time interval is stipulated (e.g., 4.8)

 

10. If, for whatever reason, SC COMATI PSG SRL cannot fulfill or has not fulfilled its contractual obligations, SC COMATI PSG SRL will find the best solution to remedy the situation or an alternative for transport, to the extent that this is possible. The costs for this must be reasonable.

 

11. We reserve the right to check, photocopy, or record in any other way your travel documents in the case of discounts granted to children, students, and pensioners, and to refuse your transport to the destination if you do not have the necessary documentation or the documents do not appear to be in order. SC COMATI PSG SRL may be subject to a fine, and we reserve the right to recover this amount from you if necessary.

 

Insurance

1. The transporter insures passengers for all bodily injuries resulting from the movement of the vehicle and their presence in the vehicle. The insurance does not cover bodily injuries generated by the passenger's fault and the transported luggage or when not in the coach.

Complaints

1. The transporter will respond to complaints within 30 calendar days.

2. Negative advertising without undergoing the complaint procedure without the recording and resolution procedure provided in this chapter having been completed is prohibited. Non-compliance with this provision gives the transporter the right to request the court for damages corresponding to the suffered prejudice.
